Payment terms & conditions
By using or seeking to use this payment transaction service, you acknowledge and agree that:
- You are responsible for ensuring that, at all relevant times, you have sufficient credit or funds in the credit or debit card account you are using to enable payment of the above "Amount to pay". If your bill payment transaction is declined by your credit or debit card institution for any reason your bill will remain unpaid and you will be responsible for any consequences (including any additional fees and charges levied by Synergy or your credit or debit card or other financial institution) arising from or in relation to that non-payment;
- Your personal information may be used and disclosed by or on behalf of Synergy in relation to this payment transaction service and as otherwise required or permitted by law. Please refer to Synergy's privacy policy which applies to how we deal with your personal information;
- Despite our efforts to ensure that this payment transaction service is reasonably secure, all electronic and telephonic data transfers and stores are potentially susceptible to interception by others. Synergy does not warrant or otherwise represent that data transfers or storage for or relating to this payment transaction service are or will be secure or free from loss or damage;
- Despite our efforts to ensure that this payment transaction service is available and works to reasonable standards, Synergy does not warrant or otherwise represent that it will be available or work all of the time or that data transfers for or relating to this payment transaction service are or will not be interrupted, corrupted or delayed;
- Synergy is entitled to cancel this service or refuse to process a bill payment request at any time and any stage, at our absolute discretion, or may require additional information from you, before we process or continue to process the request; and
- Where Synergy is, by law, taken to have given you certain consumer guarantees under the Australian Consumer Law about the supply of this payment transaction service to you, if we fail to comply with those consumer guarantees, then you may have statutory rights against us under the Australian Consumer Law that we are prohibited by law from excluding, restricting or modifying. Nothing in these terms is to be taken to exclude, restrict or modify any right, condition, warranty or guarantee (including the application of any consumer guarantee under the Australian Consumer Law), to the extent that we are prohibited by law from excluding, restricting or modifying them. All other conditions, warranties and guarantees (including any rights of recovery or to compensation), whether or not implied by law, are, to the extent permitted by law, excluded.
