Terms & conditions

  1. The Synergy “Swan Festival of Lights Facebook” competition (Competition) is a competition run by Electricity Generation and Retail Corporation (trading as Synergy, ABN 58 673 830 106) (Synergy) on these terms and conditions (Terms).  Information on how to enter and prizes form part of the Terms. Submission of an entry is deemed acceptance of the Terms. 
  2. To be eligible to enter the Competition, you must: 
    a. be 18 years of age or older;
    b. be a named Synergy account holder prior to the commencement of the Competition; and
    c. have a Facebook account,
    (Eligible Entrant).  Any entry submitted which does not satisfy the eligibility conditions detailed in the Terms, including but not limited to this clause 2, is invalid.
  3. Employees of, and contractors engaged by, Synergy, including their immediate families, are ineligible to win the Competition. 
  4. The Competition is open between  4:30pm (WST) and 8:00pm (WST) on Friday, 13 October, 2017 and between 4:30pm (WST) and 8:00pm (WST) on Saturday, 14 October 2017, or until prize pool is exhausted (Competition Period). 
  5. An entry is deemed to be received at the time it’s received by Synergy at the Synergy stand.
  6. To enter the Competition, Eligible Entrants must during the Competition Period:
    a. log into their personal Facebook page and visit Synergy’s page at https://www.facebook.com/SynergyWA ; and
    b. Submit an answer to the question on Synergy's Facebook page verbally at the Synergy stand located at the Swan Festival of Lights during the Competition Period, “Eligible Entry”.
  7. Only one Eligible Entry will be accepted for each Eligible Entrant. The first answer received will be considered the Eligible Entrant’s official entry. 
  8. Provided the prize pool is not exhausted, the Eligible Entrant will win a prize if their Eligible Entry is judged to be correct by Synergy. Only one prize may be won by an Eligible Entrant.
  9. The Competition prize consists of 20 (twenty) $20 vouchers to use at the food stall throughout the event (Prize).There are 20 (twenty) Prizes to be won in total. Total prize pool amount is valued at $400.00.
  10. The Prize will be available for collection by each winner at the Synergy stall located at the Swan Festival of Lights at Supreme Court Gardens between 4:30pm and 8:00pm on each of the following days: Friday October 13 and Saturday October 14 2017, or until prize pool is exhausted.
  11. The Prize must be taken "as offered" and cannot be varied, extended, or transferred or exchanged for cash. If the Prize is unavailable for any reason, Synergy reserves the right to offer a substitute prize of equivalent value or specification or both. 
  12. Synergy’s decision is final and no correspondence will be entered into.
  13. Any additional products or services not included in the Prize, but required by a winner, will need to be arranged and paid for by that winner. 
  14. Synergy accepts no responsibility and shall not be held legally liable or responsible for any accident, loss, injury or damage to any individual or property whether direct or indirect, whether in contract, tort, negligence or otherwise arising out of or in connection with the Competition or the Prize, before, during or after the Competition.  
  15. All Eligible Entrants agree to participate and co-operate as required in editorial activities relating to the Competition, including but not limited to being interviewed and photographed. Each winner consents to Synergy using the Eligible Entrant’s, name, likeness, image and voice (including photograph, film and recording of the same) in any media (including social media) and on Synergy's website for an unlimited period of time without remuneration for the purpose of promoting the Competition (including any outcome), Synergy and the products or services or both supplied by Synergy. Each winner agrees they will not, and will ensure that their companions do not, sell or otherwise provide their story and photographs to any media other organisation without Synergy’s consent.  
  16. If for any reason beyond the reasonable control of Synergy, the Competition is not capable of being conducted as reasonably anticipated, Synergy reserves the right, in its sole discretion, to:
    a. disqualify any entrant; or
    b. cancel, terminate, suspend or modify the Competition.
    subject to the approval of Gaming and Wagering Commission (WA) or other relevant authorities, if and only to the extent required.
  17. The Competition is in no way sponsored, endorsed or administered by, or associated with Facebook. Entrants completely release Facebook from any and all liability in connection with the Competition. 
  18. The information entrants provide will be used by Synergy for the purpose of and relating to conducting the Competition and otherwise in accordance with Synergy’s Privacy Policy and Collection of Information Statement (available at synergy.net.au). Without limitation, Synergy may disclose Eligible Entrants’ personal information to relevant suppliers, contractors and agents for or in relation to any of those purposes and to State and Territory regulatory bodies and winners’ names may be published, as required, under the relevant legislation and as set out in the Terms. Synergy’s marketing activities are subject to the Australian Privacy Principles in the Privacy Act 1988 (Cth).
  19. Nothing in these terms and conditions excludes, restricts or modifies the rights of any person or entity as a “consumer” under the Australian Consumer Law (or any other statutory rights) to the extent the law does not allow them to be excluded, restricted or modified.
  20. Synergy in its sole discretion may cancel, terminate, modify or suspend the Competition, or invalidate any affected entries, subject to the approval of Gaming and Wagering Commission (WA) or other relevant authorities, if and only to the extent required.
  21. The Competition is governed by the laws of Western Australia.
